BREAKING! Supreme Court orders retrial of Governor Tambuwal’s case

- The Supreme court has dismissed a bid by Sokoto state governor Aminu Tambuwal to stop court action against his nomination

- The apex court also ordered a retrial of the matter by a Federal High Court

- The court said Tambuwal’s nomination should be challenged by another aspirant from the state Umaru Dahiru

The Supreme Court said the matter challenging the Governor Tambuwal's nomination be retried at a Federal High Court.

The Supreme Court on Friday, December 9, dismissed an appeal by the Sokoto state Governor Aminu Tambuwal to stop court’s action against his nomination for the 2015 general election.

The court also ordered the retrial of the matter at the Federal high court.

Tambuwal had approached the apex court over a court action by the All Progressives Congress challenging the authenticity of his nomination as the flag bearer in Sokoto state.

However, in its decision, the apex court held that Tambuwal’s nomination should be challenged by another aspirant from the state Umaru Dahiru.

The five-man panel of judges led by Justice Musa Dattijo held that Dahiru has sufficient justifiable cause.

The court also set aside an Appeal Court’s decision that the court action instituted by Dahiru against Tambuwal had been overtaken by events on the strength of his election as the governor of Sokoto state.

The court said the Appeal Court erred in law by holding that the event had overtaken the case of the appellant simply because the governorship had been conducted after the primary election.

The apex court also agreed with Tambuwal that the primary election that produced him cannot be challenged by another governorship aspirant.

It said allowing such is an act of murder to democracy.

The judge further ordered that the matter be retried by a Federal High Court in Abuja, on its merit, and make decision as demanded by law.

Dahiru had in a petition challenged the process of the primary election that produced Tambuwal as the APC flag bearer in the state.

He said the process was fraudulent because the original list of the delegates for primary election was swapped in favour of Tambuwal.
